Individual Agreement for Guests
Unless otherwise stipulated in the “Individual Agreement for Guests”, terms prescribed in the “Individual Agreement for Guests” are used based on “Ticket Terms and Condition”. “Individual Terms and Conditions” and all terms and policies related to this Service (hereinafter collectively referred to as “these Terms and Conditions”.) Also, this Service will be provided and resolved on these Terms and Conditions.
Article 1 Service of the Share Ticket
“Share ticket” (hereinafter referred to as “this Service”) provided by Share Ticket Inc. (hereinafter referred to as “the Company”) is an online platform intended to support match individuals or corporations that provide accommodation facilities and experience services.
The Company makes no presentation or warranty of any kind, express or implied, with respect to the information provided by the Host, including but not limited to any representation or warranty that the Service have expected functions, commercial value, accuracy, or usefulness. The Company does not guarantee purchase of Tickets either.
Guests shall use this Service at their own risk. Guests shall give advanced notice to the Host about the troubles and circumstances that can be predicted to occur by using this Service, and use the Service after gaining consent from the Host.
Article 2 Usage of the Service
Guests can use the accommodation facilities and experience-based services provided by the Host according to the conditions stipulated in this Agreement. In using the Service, Guests shall carry out with the following:
Provide Guests’ customer information to use the Service;
Inquiry, application, reservation, and other series of correspondence related to the Service; and
Appropriate and sincere fulfillment in the establishment of ticket transaction with the Host.
Upon the Guests’ usage of the Service, the Company provides the following service to the Guests:
Management and operation of this website;
Postage and withdrawal of information regarding the Share Ticket;
Support to the Share Ticket that the Guest wishes to purchase; and
Contents Planning
The Guest shall provide information to the Company in accordance with such
manner prescribed by the Company in order for the Service to be facilitated smoothly.
Guests shall answer and provide materials without delay when they receive a request of inquiry or offering material on detailed information about the facility related to the Share Ticket that the Guest has purchased, or plans to purchase from the Company, the reservation status or past occupancy condition of the Host that the Guest could acquire through this website, the interaction between the Guest and the Host, or any other matter concerning the Share Ticket.
Article 3 From the Application of Share Ticket to the Establishment of Transaction
The Guest can select the Share Ticket they like, fill out the necessary information for purchasing the Share Ticket into the predetermined form prescribed by the Company and apply for it (hereinafter referred to as “reservation request”) in accordance with such manner prescribed by the Company.
The reservation request in the preceding paragraph will be established between the Guest and the Host when being “approved” by the Host that created the Share Ticket, and the Company will notify the User that the transaction has been established.
After establishment in the transaction of the Service, details of the service described in the Share Ticket shall be confirmed between the Guest and the Host through the communication means designated by the Company.
Article 4 Purchase of Share Ticket
The Guest shall pay to the Company the fee for purchasing the Share Ticket (hereinafter referred to as “Ticket Fee”) in accordance with such manner prescribed by the Company.
Transfer fee and other expenses required for payment shall be borne by the Guest. For the purchasing of Share Ticket, transaction of credit card specified by the Company, PayPal, bank transfer, or local settlement is available.
The Guest shall delegate to the Company to remit the Ticket Fee to paid under the preceding Paragraph 2 to the Host. However, this shall not be applied in the case of local settlement.
Article 5
Consumption tax and other taxes regarding this Service shall be borne and processed by the Guest’s expenses and responsibilities, and the Company shall in no event be liable for this matter.
Article 6
The Guest shall faithfully receive the service based on the Share Ticket after the
transaction is established.
The Guest may be subject to a cancellation fee or a fine in a case of action and behavior detrimental to the Host, such as sudden cancellation. Please use the Service after fully understanding the cancellation policy stated in the Share Ticket.
The Guest shall cooperate sincerely in response to requests of information and instructions from the Host.
When there is any change in the User Registration Information, the Guest shall promptly update this and contact the Host. However, the Company shall in no event be liable for any damage arising out of the failure of contact.
If there is a reasonable request of a report on the implementation status of the Service by the Company, the Guest shall reply in accordance with such request.
The Guest shall pay the Ticket Fee to the Host in the manner specified by the Company, and shall not pay the consideration in any unspecified manner or directly to the Host without the Company’s approval.
In case of using accommodation facilities and incidental facilities/ furniture, the Guest shall use this with responsibility under the duty of diligence.
When the Guest makes damages to the Host's building, facilities, equipment, and any other belongings (hereinafter referred to as the "damage to the Host's buildings etc."), by any reason, including use, exhaustion, damaging, or lost, the Guest shall indemnify for the damage amount. The amount includes but not limited to the damage to the Host's buildings etc.
The Guests shall manage the equipment and goods brought by themselves and the Company and Host shall not in any case be liable for these thefts, losses, and fire hazards.
The Host and the Company shall in no event be liable for injuries resulting from the use of facilities, thefts, disruptive accidents, and any other accidents
In the event of damaging or losing incidental facilities/ furniture, the Guest may be required to pay for the damages as compensation for repair. If the facility becomes unusable due to the reasons above, the Guest may be required to pay the actual price of the damage. In this case, he/ she will be required to pay the full amount of the invoice including the repair cost and the actual price of the damage on the payment date requested. The Guest shall not state any objections to this, and shall not request money or any other charges to the Host or the Company.
Discounts on ticket usage fees, refunds, and so on will not be made even if the Guest leaves the facility before the end of the contracted usage time.
When making a reservation request to a Share Ticket that the Guest wishes to purchase, he/ she will follow the settlement method stipulated by the Company.
After the termination of This Service, entering the facility without the Host and the Company’s permission is prohibited.
If it is found that the Guest is using the facility without reservation or for more than the stipulated time without acknowledgment of the Host, and if he/ she does not leave promptly, the Company will charge three times the price of the ticket (or if the Host specifies a different price, that would be applied.)
If the Guest does not leave the facility at the scheduled end time, and baggage, goods, or anything else that were brought in are not removed by the leaving limit, ownership of these baggage and goods will be considered to be abandoned, and these may be moved, taken out of the space, be disposed, and in some cases, be discarded.
In the event of a delay in leaving, the Company will charge the Guest three times the price of the Ticket Fee per day for as long as it takes to return the place to its original state as delinquency charge. (If the Host specifies a different price, this will be applied.) The actual costs for transportation/ cleaning will be charged separately.
At facilities with a key, please return it at the end of the stay as specified by each Host.
The reserved facility can only be used by the Guest himself/ herself or a group including him/ her. Transferring usage rights to third parties without permission from the Host or Company is prohibited.
In use of any of the facilities, the Company will not grant the Guest the right to lease tenant or other proprietary rights of occupation, or any specific rights such as goodwill, and no rights of the above will arise.
Article 7 Accommodation Rules
The Guest who purchase accommodation tickets must offer the following items:
Name, age, sex, address, and telephone number of all Guests;
Nationality, passport number, place and date of entering Japan, if the Guest does not have Japanese citizenship;
Accommodation date and expected time of arrival;
Departure date and scheduled departure time;
Guest may be asked to show his/ her identification card such as passport or driver’s license for confirmation; and
Other matters that the Host deems necessary.
Article 8 Opposition Period
The Guest may state objections to the Service within 24 hours after the service is provided from the Host to the Guest. (hereinafter referred to as “opponent petition term”.) The Company will refund the ticket charge to the Guest only when admitting that there is a reason for the objection, such as the Host failing to provide the service. In this case, the Guest agrees in advance that the expenses incurred by the Company in the process of refunding may be deducted from the refunded price.
Article 9 Cancellation Policy
In principle, the Guest shall comply with the cancellation policy stipulated by each Host. “Trading establishment” referred to here is limited to only when the Host “approves” the reservation request by the Guest‘s“advance settlement”.
Article 10 Disclaimer
The Guest agrees that the Company shall in no event be liable for any damage caused by the following items:
Damage caused in correspondence with reservation/ application cancellation or change of schedule;
Unauthorized use, damage to property, unnoticed cancellation, theft, accident, breakdown that occurred in the facility or the building;
Damage due to conflagration, natural disaster, leaks, and other trouble;
Damage such as compensation for business, transportation expenses, and personnel expenses, arising when the facility cannot be used on the day or from the middle of the day;
Damage given to the Host, other Guests, or third parties and self-accident due to the use of the Share Ticket; or
Any damage caused when the Guest violates the cancellation policy and notes listed on the ticket usage agreement and each page.
Article 11 Force Majeure
In the event that the fulfillment of obligation is delayed because of circumstances beyond reasonable control of the User or the Company (including but not limited to fire, electric outage, hacking, invasion of computer viruses, earthquakes, folds, war, epidemics, trade stoppages, strikes, riots, inability to secure goods and transportation facilities, intervention by government authorities, or the establishment or abolition of domestic and foreign laws), the counterparty shall not be held liable for duty failure as long as the situation continues.
Article 12 Restriction/ Cancellation of Usage
Please note that the use of Share Ticket may be restricted or canceled if the Guest or the group including the Guest falls under the following situation (1) to (15). If the Company requested the Guest for explanation regarding any of the following situation but could not obtain a reasonable explanation, the Company will deem that action corresponding with each item has already took place.
In the case of being gangs, gang related companies or organizations, professional trouble-maker at shareholders meetings, radical groups, and other anti-social forces or equivalent (hereinafter referred to as “gangsters“) or members of organized crime groups;
In the case of belonging to a corporation or organization controlled by gangsters or gangster related persons;
In the case of causing a serious inconvenience to the Host and other customers using the facilities;
In the case of resorting to violence, intimidation, blackmail, or extortion to the Host or the Company, or of requesting a burden beyond the reasonable range. Or when it is deemed that the same behavior has been performed in the past;
In the case where it is deemed that there is a danger that the Guest may act against laws and ordinances, public order, or good morals concerning the use of the facility;
In the case where the Guest or the Host is clearly recognized to be suffering infectious diseases.
In the case there is no room in the facility because of full occupancy;
In the case where it is impossible to let the Guest use the facility because of reasons such as natural disaster, facility failures, or other unavoidable reasons;
In the case it falls under the regulations and rules of the area where the facility is located;
In the case the Guest sub-leaves to a third party without permission of the Host or the Company;
In the case when it is deemed inappropriate from the point of public moral or safety management;
In the case when equipment that are out of common sense are brought in or used;
In the case when Cabinet Orders are issued by the relevant government agencies;
In the case when the Guest does not follow the Ticket usage agreement, individual contracts, prohibitions and notes applicable to Hosts and Guests of this Service, or when not following the Host’s caution;
In the case that the Host and the Company judge that it is inappropriate usage based on the conventional wisdom.
In addition, please note that even if the Company canceled the usage based on the provisions of the preceding paragraph, the Ticket Fee paid at the time of booking would not be refunded, and the damage liability that occurs at that time will be given to the Guest.
Article 13 Others
If the Company judges it necessary, the “Individual Agreement for Guests” may be changed, and when the agreement is changed, the Company will inform the Guest of the change. If the Guest uses this Service after notification of the change, or if the
Guest does not cancel the User registration within the period specified by the Company, it will be considered that the Guest agreed to the change.
